THE CDL LINE
Do box truck drivers get drug tested? Depends which side of the line
The test is whether the truck needs a CDL. Equipment type doesn't matter on its own; weight ratings and hazmat do.
COVERED
Tractor-trailer
Combination at 26,001 lb or more with a trailer rated over 10,000 lb. Every power only, dry van and intermodal rig. Class A CDL, DOT testing applies.
COVERED
Heavy box truck
A straight truck rated at 26,001 lb or more needs a Class B CDL, so its driver is tested like any other CDL driver.
NOT COVERED
Non-CDL box truck or hotshot
Under 26,001 lb, no placarded hazmat, under 16 passengers. Do non CDL drivers get drug tested under DOT rules? No, though a customer or your own company policy can require it.
If your rig moves over the line, say a hotshot upgrades to a heavier trailer and the combination reaches 26,001 lb with a trailer over 10,000 lb, you need a CDL and the full program before the first load with it. Testing done under a company policy for non-DOT drivers must be kept separate from DOT tests, on non-DOT forms.

FMCSA owner operator drug testing: you wear two hats
Under your own authority, you are the employer and the driver. As employer, you must have the program; as driver, you must follow it. The rules don't let you pick your own random tests, which is why a one-truck carrier joins a pool of two or more drivers through a DOT drug testing consortium.
You also need your own employer account in the FMCSA Clearinghouse, with your consortium named as your C/TPA, and a full query on yourself before you drive. Step by step in Clearinghouse registration.

RANDOM TESTING
Do owner operators need random drug testing? Yes, with a CDL
Random testing is the part owner-operators most often miss, because a one-person company can't select itself fairly. The rule closes that gap: a carrier that employs only itself as a driver must test randomly inside a pool of two or more drivers. For 2026, the pool must test at least 50% of drivers for drugs and 10% for alcohol over the year.

Drug testing for trucking companies with drivers
Hire your first driver and every owner-operator drug testing requirement now applies to them too: pre-employment test, Clearinghouse full query with their consent, a signed policy receipt and a slot in the pool. Then a limited query on each driver at least once a year. Each truck driver drug test result goes in that driver's file, kept for the required years.

Timing matters. Alcohol tests should be done within 2 hours; after 8 hours, stop trying and record why. Drug tests must be done within 32 hours. Keep your consortium's after-hours number in the cab.

01What happens if an owner-operator is not in a random pool?
You are violating Part 382, and it tends to surface at the worst time. A new carrier's safety audit treats failing to run a testing program as an automatic failure, and roadside or compliance reviews can bring civil penalties. Brokers and shippers may also ask for proof of enrollment before tendering loads.
02What drugs are on a DOT drug test?
Five classes: marijuana, cocaine, amphetamines (including methamphetamine and MDMA), opioids (including codeine, morphine, heroin, hydrocodone, hydromorphone, oxycodone and oxymorphone) and phencyclidine (PCP). The panel is set in 49 CFR 40.85, and a Medical Review Officer reviews any non-negative result before it is reported.
03What is return-to-duty testing?
After a violation, such as a positive test or a refusal, a driver can't drive a CDL truck again until a Substance Abuse Professional evaluates them, they complete the education or treatment the SAP sets, and they pass a directly observed return-to-duty test. Follow-up testing then continues for months or years.
04When is post-accident testing required?
Always after an accident with a fatality. After an accident where someone is treated away from the scene, or a vehicle is towed away with disabling damage, it is required if the driver gets a citation for a moving violation. Alcohol tests should happen within 2 hours and no later than 8; drug tests within 32 hours.
05Do intermodal and drayage drivers get drug tested?
Yes. A day cab pulling a loaded container chassis at 26,001 lb or more combined, with the chassis rated over 10,000 lb, needs a Class A CDL, so the driver is covered by DOT testing. Ports and railroads may add their own requirements on top, but the federal program comes first.
