FMCSA Clearinghouse registration, owner operator edition: two roles, one login

The Drug and Alcohol Clearinghouse is FMCSA's online database of CDL drivers' drug and alcohol violations. Employers must check it before hiring and every year after. As an owner-operator with your own authority you are the employer and the driver, so you register in both roles. Non-CDL box trucks and hotshots don't need it.

WHY A C/TPA HELPS

Clearinghouse for an owner operator: one office for all of it

A C/TPA (consortium/third-party administrator) runs your random pool, sends you for tests, gets results reviewed and can report violations and run queries in the Clearinghouse for you. Owner-operators who employ only themselves must designate one in the Clearinghouse.

With one named, the ongoing work lives in one place. You still log in to give consent as the driver, but you don't have to remember which report goes where.

PROHIBITED STATUS

When a record stops the truck

A driver with a violation in the Clearinghouse is in prohibited status and can't drive a CDL truck until the return-to-duty process is done: an evaluation by a Substance Abuse Professional, the education or treatment they set, and a negative, directly observed return-to-duty test. Follow-up tests then continue.

For dispatch, prohibited status means no loads in a CDL truck, full stop. We don't book a CDL driver whose status we know to be prohibited, and we pick up again when the process is complete and the record shows it.

DOT Clearinghouse for an owner operator: the yearly check

At least once a year, you must query the Clearinghouse on every CDL driver you employ, yourself included. Most carriers use a limited query, covered by a general consent the driver signs once. Put the date on your calendar: it's easy to forget when you're both the employer and the only driver.

COMMON MISTAKES

Where owner-operators get stuck

Most Clearinghouse problems for a one-truck carrier come from the dual role. These are the ones to avoid.

Registering only as a driver

A driver account lets you see your record. It doesn't make you compliant as the employer. You need both.

No C/TPA designated

A one-person carrier must name a C/TPA. Without one, your consortium can't report or query for you.

Requesting a query but never accepting it

A full query waits for the driver's consent. Log in as the driver and approve it, or it never runs.

Forgetting the annual query

Set a reminder a month before the anniversary of your first query, every year.

Get these right and registration takes an afternoon. After that, the account needs a few minutes a year: one annual query, one consent, and a check that your C/TPA is still the one you pay.

01How do I register as an owner-operator in the FMCSA Clearinghouse?

Create a Login.gov account, then register in the Clearinghouse as an employer under your USDOT number and also as a driver with your CDL details. Buy a small query plan, designate your consortium as your C/TPA, then run a full query on yourself and accept it from your driver account before you drive.

02What is driver consent in the Clearinghouse?

Before an employer can run a full query, the driver must log in and give electronic consent for that specific query. For limited queries, the driver signs a general consent, often on paper, that can cover a year or the whole period of employment. As an owner-operator, you give consent to yourself.

03How often do I need to run a query?

A full query before a driver first does safety-sensitive work for you, and at least one query, usually a limited one, on every driver each year after that. If a limited query shows that information exists, you must run a full query within 24 hours or take the driver off duty.

04How much does a Clearinghouse query cost?

FMCSA lists queries at $1.25 each, full or limited, sold in bundles that don't expire. A one-truck owner-operator needs only a couple a year: one full pre-employment query and an annual one. Many consortiums can run them for you once designated as your C/TPA.
